Federal Disability Retirement: Maintenance of Sanity

Is that what life has become?

One comes into the world with sanity (for most), and the fight throughout one’s life is to try and retain and maintain that semblance of cognitive equilibrium.  We tend to think, in modernity, that there are certain “basic rights” which apply to all human beings — a minimum level of subsistence; that one should be allowed a place to live, some food to eat, etc.

short review of history, however — even on a superficial level — readily and easily reveals that the greater lot of humanity suffered tremendously for centuries untold; that most were either in the peasant or serf class, and the daily struggle just to obtain food for survival constituted the primary focus for most.

Once a system of “middle class” standards were invented, where some leisure time allowed for engagements beyond mere subsistence living, hobbies and pastimes involving entertainment, reading, pleasurable distractions and thoughts involving preludes to abstractions became more and more available to a greater number of people.  To a point where, in modernity, in current times and circumstances, it is less the physical health which most people are concerned with, but rather, the cognitive unhealthiness in a stress-filled society.

Maintenance of sanity has become the mainstay of modern living; focus upon one’s mental health, of greater necessity.

For Federal employees and U.S. Postal Service workers who have struggled and recognized the progressive deterioration of one’s mental/nervous health — of Major Depressive Disorder; PTSD, Uncontrollable panic attacks; Schizophrenia; Bipolar Disorder; etc. — do not let the U.S. Office of Personnel Management fool you into thinking that Mental Disorders are somehow second-class citizens to Physical Ailments; in the law, they are to be treated as co-equals in the validity of evaluating disabling medical conditions.

OPM Disability Retirement: The Past We Imagine

To live in the past is to stunt growth; to merely exist for the present moment, an afterthought’s condiment to the greater self we can be; and to constantly strive for the future is to lose the meaning of life.  There is always a balance to be reached — not only in the past; not merely in the present; not solely for the future.  The three negations — of not, not and not — is a difficult recipe to bake.

Aristotle’s Nicomachean Ethics attempts to teach of the middle or “mean” path, but these days, modernity is unable to comprehend his teachings because we no longer understand the concept of moral virtues.

In modernity, nothing moral is of any consequence (there we go again with the negation of a concept).  So, let us try and delete and extinguish the negations, and rephrase it in positive terms, if we can.  Often, the past we imagine is not the true characterization — for, that terrible childhood we experienced in contrast to the perfection of our neighbor’s past, is often a false magnification of our biased memories. Many of us had bad childhoods; of terrible, destructive parents; of neglectful siblings; of hard times.

First, rebuild the past memories; compartmentalize the negatives and focus on the happy ones.  Second, don’t compare your present circumstances to the past, but paint a picture of hope for the future.  And third, formulate a positive statement for the future — such as, “There is always a pathway forward, under any circumstances”.  Then, live the life of virtue by sticking to the balance between past, present and future.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of the Federal or Postal worker’s job duties, the future may need to be “painted” with an effective application for Federal Disability Retirement benefits.  The past we imagined must now be set aside; the present circumstances must merely be endured; the future may involve a different career, but it is nevertheless a pathway forward.

OPM Disability Retirement under FERS: Interests at odds

A comity of interests has to arise in order for relationships to “work” — in whatever arena of meaning such a term must apply.  When interests are at odds, it means that the goals, orientation and direction of each of the parties are conflicted.  A “conflict”, of course, can be direct or indirect, and can be on various levels of complexities, but in general would imply a need to sever ties unless such conflicts are resolved.

In the employment arena, the comity of interests is fairly straightforward: The employer has a set of interests that need to be pursued; the employee, desiring to advance the interests of the employer, agrees to join in with the comity of interests in the common pursuit of stated goals.  Compensation is agreed upon; certain conditions are mutually stated and a contract, whether explicit or implied, is formed.

Conflicts may arise during the course of employment, of course; if a competitor makes an offer to the employee unbeknownst to the employer that directly or indirectly conflicts with the stated goals of the employer, certain ethical questions may arise.  Or, if certain employment conditions fail to be met, the “interests” of each begin to be “at odds” — an odd way of putting it, but that is the lexicon that has arisen in the employment arena.  It is almost a euphemism to avoid the harsh reality of other “choice” words.

Medical conditions can certainly “bring to odds” and damage the employer-employee relationship, and certainly Federal employees and U.S. Postal workers recognize that.

The “solution” that has been preemptively provided is the benefit known as “Federal Disability Retirement” — it is a means to avoid or otherwise resolve the conflict that arises when a Federal employee or Postal worker can no longer perform one or more of the essential elements of one’s Federal or Postal job — where, in the event of a medical condition no longer allowing for the Federal or Postal employee to fulfill certain of the employment conditions agreed upon (i.e., not being able to maintain a regular work attendance; unable to work full time any longer; taking too much SL or LWOP; unable to perform all of the essential elements of one’s job, etc.), then it is time to access the benefit of filing for Federal Disability Retirement benefits, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

Of course, the “interests at odds” is not just between the employee and one’s own Federal Agency or the Postal Service — it is also as against another agency: The U.S. Office of Personnel Management who attempts to subvert, deny and otherwise place obstacles in obtaining an “approval” for Federal Disability Retirement benefits.

OPM Disability Retirement Help: The Man from Mars

It is a strangeness that cannot be avoided.  Sort of like Thomas Nagel’s famous philosophical essay, “What is it like to be a bat — for a bat?”  It is the “for a bat” that makes all of the difference; for, as Nagel himself pointed out, it is easy to imagine what it is like to be a bat — i.e., have wings, fly in the dark of night, screech, eat bugs, etc.  However, the uniqueness of actually being another creature — of having a separate and distinct perspective from that of a human, man-centered purview — is something that we will never be able to achieve.

Others, like those in Daniel Dennett’s camp, counter that there is no Searle-like “ghost in the machine”, and that consciousness is merely comprised by the aggregate of the neurological connections that make up the human body, and there is nothing metaphysical beyond the physical, no “trans” or “meta” existence beyond the firing of neurons and wired transmitters — in other words, the uniqueness of an individual is nothing beyond what we see and experience.

The cynic, of course, would look at the neanderthal that we have become, where we stare into our Smartphones like zombies and laugh uproariously as the crudest of jokes, and nod in agreement.  But what of the experiences of the extraterrestrial — does that shed any further light upon the issue?

Take, for example, the concepts explored in works like, The Man who Fell to Earth, starring David Bowie, or Robert Heinlein’s story of science fiction, “Stranger in a Strange Land” — where an alien culture and perspective meets with the consciousness of the banality found on earth; is it any different than when Native Americans first saw the ships appear upon the horizon of the Americas?  What is the natural response of the Man from Mars, and what is our response when confronted by an alienation of cultures, processes or foreign encounters?

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, the strangeness of the experience itself is often daunting, at least in two or three ways: First, the medical condition itself is a phenomena that is alien, where previously the Federal or Postal employee was a healthy, vibrant individual.  Second, the fact that the Federal or Postal employee cannot “do it all” is another foreign concept that one has to adjust to, and that is often difficult enough.  And Third, the experience of meeting adversity and sensing a negative reaction by one’s own Federal Agency or the Postal Facility one works at — that, too, is a foreign and alien experience, where before the Federal or Postal employee felt like he or she was a member of that “team”, and now the treatment accorded is one likened to a plague or infectious disease.

Preparing, formulating and filing an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, whether he Federal or Postal employee is under FERS, CSRS or CSRS Offset, is often an experience likened to the Man from Mars — and because of this, the Federal or Postal employee who needs to consider Federal Disability Retirement might want to consult with a tour guide, otherwise known as an attorney who specializes in the attractive sights on Mars and within the purview of the U.S. Office of Personnel Management.

OPM Medical Retirement Legal Representation: Lives abstract and pointless

It is easy to speak about others in an abstract and pointless manner.  What is more difficult is to engage the complexity of a human being.  When we refer in such a manner, and reduce to a conceptual entity, the minimization allows one to refer to “it” as an object of derision.  Thus can one subordinate and state without feeling, “Oh, X is worthless” or “Y is a waste of time”, as if the value of an individual can be quantified like mineral ore or spectrums of inestimable qualities.

It is the cognitive process which is likely unique to the human animal, and has been variously evaluated, assessed, judged and analyzed by different philosophical schools of thought, under multiple titles like “An inquiry into human understanding” or “The puzzle of the human mind”.

Abstraction, placement of sensible objects into forms of conceptual paradigms otherwise negated by the particular; these generalizations have a duality of purpose, of utility that can be moral or evil, deliberative or of pointless venue.  Obliteration of the particular is consistent with the capacity of a nation to subjugate and murder in mass quantities, for it is by the vehicle of objectification that the subject can be ignored and shirking of humanity can be achieved.

From the ashes of the Second World War rose the stems of Existentialism, and Sartre and Camus positing the anguish of dead souls unable to experience the fullness of life.  And thus was the hero an unlikely one – of a solitary figure toiling despite the severing of that which gives impetus to life: the relationship between meaning and motivation.  For, Sisyphus was condemned to engage for eternity in the monotony of toiling to push the boulder up the incline, only to have it roll back down, then to repeat the senseless act endlessly.

It is this metaphor applied to life itself, and by which existentialism sought to bring meaning and purpose to the human condition.  That is why relegation to abstraction and subjugation to pointless conditions became the clarion call of protest for the tide of human suffering, like the Phoenix rising from the ashes of war left to devastation and human misery.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of the Federal or Postal positional duties, the experience of being referred to as lives abstract and pointless becomes a daily encounter; for, Federal Agencies and Postal facilities place value upon the Federal or Postal worker only so long as productivity and the advancement of the Agency’s mission continues; and thus is loyalty defined as a one-way street leading up to the Agency’s doorstep or the Postal Service’s bottom line; never does loyalty embrace the Federal or Postal employee’s medical condition.

Preparing, formulating and filing an effective Federal Disability Retirement application, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is a way to break that endless cycle of Sisyphean plunder; for, in the end, lives abstract and pointless are defined not by what “they” are doing, but what you – the unique individual – are capable to doing, and escaping the harassment and adversarial actions of the agency by obtaining a Federal Disability Retirement annuity is often the best and only choice to attain that purposive goal.

OPM Disability Retirement: Arrive with bluff, depart with bluster

That has become the motto of universal exceptionalism; it is the bravado of the incompetent, the arrogance of the ignorant and the methodology of the unwary:  besides, it is a funny line plagiarized from a work by Evelyn Waugh (no, that is a male writer, not a female).

It is to come into a circumstance, a job, an assignment or a social conduit acting like one knows what one is doing, messing everything up, then leaving the desecration of incompetence and a heap of human detritus for others to deal with, while all the while turning up one’s nose, shaking the proverbial head in disgust, and departing with an unjustified defense of one’s own incompetence with:  “You guys are hopeless.”

That is the guiding declarative foundation of all self-help books, advice columns and Oprah-wanna-bees in columns of suspicious pearls of so-called wisdom:  “The key is to act like you know what you are doing, with confidence and assertiveness; the rest will follow and everyone will believe in you.”  Or, in other words, believe in yourself despite not knowing anything; act with declarative arrogance; be self-confident (of what, we are never told) and take charge of your life.  Then, if things don’t work out, don’t be too hard on yourself (or, better yet, not at all) and don’t ever allow others to get you down.

Such a foundational folly of methodological madness fits in very well, and is completely commensurate with the cult of youth; for, even if we all know that the younger generation knows not anything but having been coddled throughout their educational years (hint:  a euphemism for indoctrination for heightening self-esteem), the world generally operates on its own in spite of massive and daily incompetence, but that is precisely why there is a need to hire a dozen people for every job:  quantified incompetence somehow makes up for qualitative lack.

Once upon a time, bluster was known, recognized and dispensed with; and bluster was laughed at, mocked and ridiculed.  Now, it is an everyday and common occurrence, because the substantive basis has been ripped out and the soul is now an empty cavern of echoing banter steeped in words of meaninglessness topped by nonsensical linguistic cacophonies of boundless chatter.

Yet, there are times when substance matters, as when a Federal employee or U.S. Postal worker experiences a medical condition, such that the medical condition begins to threaten one’s ability and capacity to continue in the position one is designated in.  That is the time when neither bluff nor bluster is desired, needed nor welcome.

Honest answers and forthright advice is what needs to be obtained, both from Supervisors, coworkers and Human Resource personnel; in the legal advice rendered and received from one’s Federal Disability Retirement lawyer; and from friends, family and loved ones in pursuing this very difficult bureaucratic process couched within a cauldron of administrative nightmares.

We arrive into this world without a clue; we learn to bluff, even when we don’t want to; and when we depart, it is up to us as to whether there needs be an imprint of bluster, or whether the honesty that still resides in the essence of our soul may still reveal a vestige of the true character we maintained, in preparing, formulating and filing an effective Federal Disability Retirement application, whether the Federal employee or U.S. Postal worker is under FERS, CSRS or CSRS Offset.

FERS & CSRS Disability Retirement: The numerical veil

Statistical constructs indicate group shifts and movements; numbers, based upon controlled samplings, provide the substantive fodder for analysis of trends and patterns of population deviancies.  There is, however, the question of the incommensurate nature between mathematical paradigms and linguistic application; stated more simply, Do numbers hide more than reveal, and can anything be extrapolated from them and interpreted in terms we can understand and comprehend?

To a winner of the lottery, the numerical phantasm “one in a billion” remains meaningless; and to the dismissive statistical irrelevancy stated in language more readily comprehended, that there is a greater chance of dying in an automobile accident than from a shark attack, becomes inconsequential and of little comfort if you are laying in a hospital bed with a good part of your flesh missing from such a traumatic event.  That’s the problem with numbers, of course, and the use, misuse and abuse of statistical analysis; in the end, it depends upon how it is used, the methodology of discourse, and the manner of application.

To be hit by lightening may well be more uncommon than death by drowning, but if your job is to be a caddy for an eccentric billionaire who enjoys golfing on days of severe weather patterns, the generalizations ascribed by comparative mathematical analysis may be somewhat skewed.  And, of course, for romance of young couples who scoff at divorce rates and patterns affirmed by celebrity lives and the cultural meltdown pervasive throughout, the lack of life experiences, the want of provocation through trials and turmoils yet to be encountered and not yet encumbering, allows for hope, charity and a sense of optimism despite the universe which surrounds of cynical diatribes.

We take comfort in the veil of numbers, precisely because we can manipulate them in the ways we want.  Facing a bleak outlook, we can justify resistance with a dismissive wave of the hand (or that invisible wand of magic and sorcery) and declare, “Well, the chances are…”  Numbers never tell of the human emotions and toil of reality; they remain as cold mathematical calculations, jiggered and manipulated by the picture of emotionless bureaucrats who wear spectacles to magnify the inconsequential harm imparted upon the lives left behind.

And for Federal employees and U.S. Postal workers who must file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management?  Such individuals, whether under FERS, CSRS or CSRS Offset, become part and parcel of the statistical conundrum who once had names, faces and identities, but somehow became relegated into the numerical aggregate of “those” people who departed by filing an effective Federal Disability Retirement application through OPM, all because they could no longer perform one or more of the essential elements of the positional duties assigned.

Does such fear of becoming a mere irrelevancy of statistical obscurity make the Federal or Postal employee pause, despite the chronic pain or the psychiatric despondency which tells of the urgency to file for the benefit?  Probably.  Yet, beyond the numerical veil which hides, each Federal or Postal employee who departed and left behind such a statistical imprint, go on to live productive lives thereafter, with ongoing emotional ups and downs, as real people, living authentic lives untold by the hidden abyss echoing from the chambers of silent digits.

FERS & CSRS Disability Retirement: The implication of ‘finding happiness’

Human beings live in a duality of universes; within the linear historicity of an objective world, daily unfolding with encounters with physical objects and other beings, comprised of interactions both superficial and intimate, combined with utilization of inanimate constructs for daily living; then, there is the insular universe of a parallel phenomena, where we are subsumed by a conceptual menagerie of language, numbers, extrapolated forms of ideas and strings of thought processes; and how we coordinate and intersect the two determines the success or failure of who we are, how we thrive and to what teleological end we pursue.

The words which we use often define who we are, as well as what motivates and moves us into action or inertia of mindless behavior as science fiction describes the modernity of automatons.  In the animal, non-human kingdom, survival and the pursuit of food sources dominates to satiate the basic tendencies of the appetitive aspects of existence.  ‘Happiness‘, as a defined principle, equates to a full stomach at the most foundational of sources.

For humans, we tend to make complex of the simple, and turn an evolutionary basis into a conceptual conundrum.  Thus do we add the prefatory vacuity of ‘finding’ and attach it to the root of existence — ‘happiness‘.  Such a concept implies that there existed a time before when something was lost, never attained, or otherwise left unsatisfied.  As a result, a ‘search’ is undertaken, a lost civilization reenacted, a missing person found and a stray dog reunited with its owner.  But that life were so simple as to merely search for the confounding link to fulfillment, as if the effort merely consists in the remembrance of the location of the misplaced watch by tracing the steps previously taken but somehow forgotten during the slumber of exhaustive nights.

Is life too complex to behold?  Do the accoutrements of cultural rot pile upon us daily, such that the simple root of conceptual simplicity remains beyond the reach of most of us?

Happiness as a principle should always remain as a byproduct of the life one leads.

For Federal employees and U.S. Postal workers who suffer from a meandering pool of daily suffering, resulting from a medical condition which prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Postal or Federal positional duties, the issue of ‘happiness’ is often quite simple:  freedom from the medical condition and stability of purpose for the future.

The former may never be quite achieved, as it is determined by factors so complex as to encompass body, soul and emotional health; but as to the latter, filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is at least a step in the proverbial right direction.  For, in the end, the insularly devoid conceptual construct of ‘finding happiness’ must be determined by the angel’s residue of sprinkled gold dust, left to sparkle with infinite radiance as we venture forth into worlds unconquered and visions yet unseen.

OPM Disability Retirement: Elevation of the Federal Consumer Product Compliance Directorate (FCPCD) to a Cabinet-level status

It first came to light in August, 1974, just prior to Nixon’s resignation from Office.  A young reporter by the name of Dan Druthers asked the President:  “Have you considered the exponential factor of time wasted in consumer affairs concerning crushed toilet paper rolls during transport and delivery?  What has your Administration done about it?  The American People demand an answer!”  The White House Press Corps was aghast.  No other journalist had had the temerity to heretofore question the Presidency with such forcefulness.  The President, of course, was stumped, and shot back, “Mr. Druthers, what do you think you are running for?”  To which Mr. Druthers shot equally back, “Well, I’m not sure.  What are you running from, Mr. President?”

The rest is history, as they say.  From there, that journalist of slight anonymity and notoriety went on to become the anchor of Prime Time T.V.; the President resigned (what many people fail to understand is that Watergate had little to do with moral turpitude, and much to do with messy toiletry); the 18-minute gap in the secret White House Tapes, people suspected, had to do with deleted expletives concerning Toiletgate; and as for the greater issue of crushed toilet paper rolls — well, it took a few more years hence before the political fallout would take its toll.

First, there were whispers of grumblings, of esoteric nuances which could only be fully understood in Senate closed door hearings where titular heads of states whispered in royal functions.  How many people spend time in straightening out a roll of toilet paper, such that it rolls smoothly on a roller?  If, as a conservative estimate, 30 seconds are spent for each crushed roll of toilet paper, multiplied by the total number of people inhabiting the United States, how much of an economic impact would that have on an annual basis?  How much time would be saved if such crushing of toiletries could be prevented, reverberated a thousandfold — nay, ten thousand fold — by mere and simple preventative measures?

The question itself failed to take hold upon the American imagination, until some years later, at a Town Hall Meeting, a woman asked a Congressional Candidate a similar query, in a rather accusatory tone of voice:  “Do you not care at all?”  That got the goat of the candidate, as they say in proverbial parlance.  There were subsequent cries for immediate passage of legislation.  Republicans wanted a budgetary offset for any monies expended for the creation of a new agency, the Federal Consumer Product Compliance Directorate (FCPCD). Some questioned the need for the new agency, and whether it couldn’t just be handled by the EPA; but such queries were quickly quelled when the Senate Majority Leader declared:  “The issue itself is too important to ignore.”

In the end, the FCPCD was created by Executive Order.  Some years later, because of the very importance attached to such preventative measures — “experts” referred to the greater impact upon global warming, and some at the NSC declared that it was a matter of “national security” — the FCPCD was elevated to a Cabinet Level Department post haste, in order to ensure that the President was daily informed as to the importance of the issue and so the American People would not be ignored. The staff at the FCPCD grew from 2 in 1984 (comprised of the Executive Director and the secretary), to over 5,000 today and currently growing (you know, inspectors, analysts, policy experts, etc.).

Meanwhile, those Federal and Postal workers who had filed for Federal Disability Retirement benefits with the U.S. Office of Personnel Management, continue to wait for their Federal Disability Retirement applications to be decided upon.  The fact that OPM is understaffed and overworked has not been brought to light, yet.  Of course, OPM does not have the ear of the President, and the issue was never queried by the likes of a crack reporter back in the days when reporting was actually occurring.
