Office of Personnel Management (OPM) Disability Retirement: Sufficiency

There is always a measure of subjectivity involved, of course.  Following the Council of Trent, the issues which prevailed as a response to the Protestant Reformation involved Church doctrine and clarifications needed concerning issues involving “sufficiency” of grace, whether the human will could engage in acts of the “Good” without it, and so many other interesting minutiae of proper wording which is now irrelevant in this postmodern era.

What is sufficient; what qualitative or quantitative determinations meet that criteria; is there an objective set of rules and regulations requiring sufficiency, and how is it determined to have been met?

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, “sufficiency” of information is a critical criteria to be met in every Federal Disability Retirement case.

Medical Retirement for Federal Employees: The World in Upheaval

These are chaotic times; all around us, the things we relied upon, the places we visited regularly, the people we gathered with — crumbling, coming apart, corona virus.  Sometimes, it seems too much to bear.  How will this all end?

OPM Disability Retirement under FERS: Conflict of Priorities

It happens within friendships, within marriages; within all interactions of relationships, where contending forces of wants, desires, needs and goal-oriented activities intersect between one’s own and those of others.  Whether we can reorder and reorganize our own; to what extent the “other” is willing to subjugate or subordinate theirs in order to compliment your own; these are the filaments which bring about the illumination of a relationship, or leave it behind in the darkness of yesterday’s dreams.

The conflict of priorities is what destroys relationships, splits up marriages and divides friendships.  We often hear the euphemisms of life: “We drifted apart”; “We just didn’t see eye-to-eye on some things”; “We found ourselves arguing more than it was healthy to”, etc.  These are declaratives where conflict of priorities destroyed the friendship of relationships.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, the conflict between taking care of one’s own health and performing at an acceptable level at one’s Federal or Postal job should never be in question.  Health should be priority number 1; all else, secondary.

Medical Retirement under FERS & CSRS: Deviating and adapting

How does one deviate or adapt, if one is approaching something anew?

Such concepts as modifying or altering a methodology presumes that one has encountered the process before, and thus it stands to reason that a person who has never previously experienced something before can hardly be expected to provide new insights when the experience itself is new to the individual.  That is why we often refer to a person’s ability and capacity to “think on his or her feet” — meaning, to quickly encompass and adapt to new and fluid circumstances, despite a lack of familiarity with an onslaught of speedy changes.

Deviating, of course, can be a negative component, in that it may imply altering from a true-and-tested course of action, and unless one is certain of one’s confidence in a new path taken, there may ensue disastrous consequences when following a rebellious path that can lead to the unknown.  Many a trailblazer who knew not the way of the unbeaten path have perished by starvation or thirst.

On the other hand, we consider the capacity and ability of “adapting” to be a positive characteristic, in that it implies a characteristic of being able to respond to external circumstances that are changing, and requires a willingness to bend with the winds of change.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition begins to prevent the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, the dual concept of deviating and adapting comes to the fore precisely because of the need to change — both on the Agency/Postal Service’s side, as well as from the perspective of the Federal or Postal employee.

For the Federal Agency or the Postal Service, the issue of deviating and adapting comes about in terms of “accommodation” — for, it is necessary for the Federal Agency and the Postal Service, by force of law, to “deviate” from the former ways of behaving, and to “adapt” to the medical conditions and changes that the Federal or Postal employee is undergoing.

From the viewpoint of the Federal or Postal employee, deviating and adapting may encompass a wide range of issues in terms of accommodations — whether the situation and conditions posed are temporary or permanent by nature; whether the medical conditions suffered are able to be accommodated at all, either temporarily or permanently; and whether attendance is an issue; of how much SL must be taken; of FMLA issues and extensions of LWOP beyond, etc.

In the end, deviating and adapting from the “norm” may not be possible, in which case preparing, formulating and filing an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, may become necessary.

For all Federal and Postal employees, what is important to remember is that suffering from a progressively deteriorating medical condition will require deviating and adapting, and that may include the need to have expert legal guidance by an attorney who has previously had the experience in preparing an effective Federal Disability Retirement application so that any and all deviations and adaptations can be initiated from the perspective of previous experience, and not as a trailblazer off of the beaten path where getting lost in the complexities of Federal Disability Retirement Laws can lead to disastrous results.

Hope’s extinguishment is often a result of failing to consider alternatives when imagination is left to the recesses of dark days and sleepless nights; for, in the end, Federal and Postal employees should always consider all benefits available, and preparing, formulating and filing an effective Federal Disability Retirement application, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, may be the pathway to reignite hope’s extinguishment.

Federal Employee Disability Retirement: Fodder for our own folly

We often collect that which we know we need not; and of fodder for other’s play, who but the foolish gather the refuse of one’s own folly?  Why does youth engage in a greater percentage of folly, and why do old men insist upon driving uncomfortable cars which make them look foolish once they park and struggle to get out from a position of near-supine discomfort so debilitating that you can almost see the decrepit arches of an arthritic back?  Foolishness, of course, is not the reserve of the young only, as middle-aged men with youthful grins and old men with conniving friends whose sole purpose in remaining a soul-mate is contingent upon peeking at the bank account of retirees, reveal and manifest daily.

In the end, the test that has always worked for this writer, is twofold:  First, that sincerity is never defined by more words piled upon a previous set of words, but action which follows to concretize the empty promises of uttered speech; and Second, that everyone in the world can do whatever he or she wants, so long as you are willing the pay the price.  Thus, as to the latter, it is all well and good to say you want to do this or that, but the problem occurs when consequences unfold, and you expect others to pay the fine, complete the obligation, satisfy the debt or expend efforts to extricate from the difficulties created.

For children, there is always an excuse:  Parental obligation and the minor’s claim of not having the maturity to “know better”, compels a feeling of empathy, a reminiscence of remorse, and a hint of guilt for not having spent that extra hour coaching youth baseball or embracing that “quality time” which forever harmed that fragile psyche of that young underling who – by all other measures of objectivity – is described as merely a “brat”.  Of the former, one must simply admit that the American folklore of a fool being born every minute – or was it every second? – is reinforced by our own inability to consecrate the condoning cadence of our corrugated cacophonies of constancy; sorry, but once alliteration becomes engaged, it is like putting a finger on the trigger of an automatic weapon and losing control.

More to the point:  Most arguments are non-substantive.  By that is meant the following:  there is rarely a “real” issue of disagreement, but rather, a mere necessity to renegotiate the words used in order to fit into a puzzle where two or more people interact.  That being the case, most issues that arise, are resolved with more words imparted, which is simply a further negotiation of words upon words in a language game of meaning, reinterpretation and declaration of purpose.

But as being foolish has a price to pay (refer to the Second Rule stated herein), so the need to follow up with a concrete action, instead of more words (i.e., the First Rule stated above) is necessitated when real issues that have an impact and consequence effect upon lives of others.  Most problems in life are self-creations; those who have a greater ability to justify by blaming others, simply get away with it without blemish or repercussions.

For Federal and Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from continuing on in the career of his or her choice, the exception to the above applies:  Medical conditions are never the fault of one’s own, and so Rule One and Rule Two should never be considered.  It is, instead, Rule Three (heretofore unstated) which should rule:  Prepare the most effective Federal Disability Retirement application you can, and file it as soon as practicable, as the wait before the U.S. Office of Personnel Management is long and arduous, but always keep in mind the fodder for our own folly applies to everyone individually, including those within a massive bureaucracy as that of OPM.

OPM Disability Retirement: Elevation of the Federal Consumer Product Compliance Directorate (FCPCD) to a Cabinet-level status

It first came to light in August, 1974, just prior to Nixon’s resignation from Office.  A young reporter by the name of Dan Druthers asked the President:  “Have you considered the exponential factor of time wasted in consumer affairs concerning crushed toilet paper rolls during transport and delivery?  What has your Administration done about it?  The American People demand an answer!”  The White House Press Corps was aghast.  No other journalist had had the temerity to heretofore question the Presidency with such forcefulness.  The President, of course, was stumped, and shot back, “Mr. Druthers, what do you think you are running for?”  To which Mr. Druthers shot equally back, “Well, I’m not sure.  What are you running from, Mr. President?”

The rest is history, as they say.  From there, that journalist of slight anonymity and notoriety went on to become the anchor of Prime Time T.V.; the President resigned (what many people fail to understand is that Watergate had little to do with moral turpitude, and much to do with messy toiletry); the 18-minute gap in the secret White House Tapes, people suspected, had to do with deleted expletives concerning Toiletgate; and as for the greater issue of crushed toilet paper rolls — well, it took a few more years hence before the political fallout would take its toll.

First, there were whispers of grumblings, of esoteric nuances which could only be fully understood in Senate closed door hearings where titular heads of states whispered in royal functions.  How many people spend time in straightening out a roll of toilet paper, such that it rolls smoothly on a roller?  If, as a conservative estimate, 30 seconds are spent for each crushed roll of toilet paper, multiplied by the total number of people inhabiting the United States, how much of an economic impact would that have on an annual basis?  How much time would be saved if such crushing of toiletries could be prevented, reverberated a thousandfold — nay, ten thousand fold — by mere and simple preventative measures?

The question itself failed to take hold upon the American imagination, until some years later, at a Town Hall Meeting, a woman asked a Congressional Candidate a similar query, in a rather accusatory tone of voice:  “Do you not care at all?”  That got the goat of the candidate, as they say in proverbial parlance.  There were subsequent cries for immediate passage of legislation.  Republicans wanted a budgetary offset for any monies expended for the creation of a new agency, the Federal Consumer Product Compliance Directorate (FCPCD). Some questioned the need for the new agency, and whether it couldn’t just be handled by the EPA; but such queries were quickly quelled when the Senate Majority Leader declared:  “The issue itself is too important to ignore.”

In the end, the FCPCD was created by Executive Order.  Some years later, because of the very importance attached to such preventative measures — “experts” referred to the greater impact upon global warming, and some at the NSC declared that it was a matter of “national security” — the FCPCD was elevated to a Cabinet Level Department post haste, in order to ensure that the President was daily informed as to the importance of the issue and so the American People would not be ignored. The staff at the FCPCD grew from 2 in 1984 (comprised of the Executive Director and the secretary), to over 5,000 today and currently growing (you know, inspectors, analysts, policy experts, etc.).

Meanwhile, those Federal and Postal workers who had filed for Federal Disability Retirement benefits with the U.S. Office of Personnel Management, continue to wait for their Federal Disability Retirement applications to be decided upon.  The fact that OPM is understaffed and overworked has not been brought to light, yet.  Of course, OPM does not have the ear of the President, and the issue was never queried by the likes of a crack reporter back in the days when reporting was actually occurring.

Medical Pension from Federal Government Employment: Pulse of the heart, eyes of the mind

Lin Yutang is a preeminently accomplished writer of the last century who wrote incisive essays and works describing the great divide between China and the monolithic aggregate collectively referred to as “the West”.  It was a different time of which he wrote, as the world was larger, more divided, and inaccessible to many; prejudices and biases still prevailed, and the attitudes of former colonialists still ravaged the minds of ignorance and fear, where political correctness had not yet tilted the ingrained cultural condemnations of group-think and herd mentality.

In the end, however, as with all great writers and perceptive thinkers, his spectrum of thought touched upon universal truths which captured and encapsulated the greater generic congregation of humanity, and not just the separateness relegated to the trash bin of historicity.  It is a paraphrase of the description used by him, but one which he would likely have agreed to — that a complete man needed both sides of humanity:  both the pulse of the heart as well as the eye of the mind, like yin and yang, emotion and rationality, objectivity and empathy.  But the pendulum of time in every epoch seems never to balance well between the extremes of masculinity and femininity; we must either be all of one and vanquish the other, or deny ourselves the true origin of our own essence.

That type of behavior is often seen in the microcosm of everyday living, including those with medical conditions and disabilities in the Federal sector and the U.S. Postal Service.  Whether out of fear or unforgivable ignorance, people tend to treat others with medical conditions and disabilities with a quiet disdain, lacking any import for empathy or concern for livelihood.  For Federal employees and U.S. Postal workers, whether under FERS, CSRS or CSRS-Offset, the only pathway out of such inhumane treatment and lack of empathetic humanity, is to file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management.

This is not an “out” for escape, but a reality of conserving the dignity of one’s life, in order to attain a level of financial security and move on to a better and more productive phase of one’s life.  For, when others lose one’s pulse of the heart, as well as deny the eye of the mind, all sense of decency and good-will becomes lost to the abyss of evil and human depravity; and as the imbalance of man’s essence brings out the worst in us, so the best option left for the Federal or Postal worker who is being harassed and pilloried at work, merely because he or she can no longer perform one or more of the essential elements of the Federal or Postal positional duties assigned, is to prepare an effective OPM Disability Retirement application before the yin is severed from the yang, and the pendulum of time swings forth to shatter the glass casing within the quietude of the chime of marching lives.

Medical Retirement from Federal Government Agency: Alliances

Meritocracies are built upon an ideal of competency; quickly, however, as reality creeps into the ineffable truth of what actually occurs, people tend to fall back upon the comfort zones of unspoken alliances, allowing for protective measures tantamount to the nuclear paradigm of mutually assured destruction in saving one’s own skin.

The person who goes to work with quiet competency believes that hard work and incremental contribution will ultimately win out the day; the hardy laughs outside of the office echoing down the hallway with vague reverberations of mirthless camaraderie; the social events invited with a mere pop-of-the-head mention in passing by, but quickly with the added disclaimer of, “Oh, it won’t be much fun, but you’re certainly invited,” as if you are offered a discount coupon which needs only to be cut out and brought with you, but no scissors are provided and tearing such conveniences outside of the dotted line is considered in bad taste; and the Monday recounting of the get-togethers with back-slapping tales of associations forged and assuredly irrelevant to the work at hand, but somehow those quiet stares held for a moment too long between unspoken alliances concretized in what once was described as backroom deals filled with cigar smoke and consideration exchanged under poker tables, comes back to haunt in subtle ways in misdeeds of unaccounted time.

When a crisis hits the fan, favoritism is always denied, despite the facts which betray the truth.  For Federal employees and U.S. Postal workers who must consider preparing for another vocation because the one presently positioned is no long viable, resulting from a medical condition such that the medical condition prevents one from performing one or more of the essential elements of one’s Federal or Postal positional duties at the Federal agency or the U.S. Postal Service, it often becomes evidence that the leeway given for approving FMLA in the meantime, or liberal leave policies, redistribution of workloads in order to temporarily accommodate or suspend many of the essential elements of one’s Federal or Postal positional duties, is based not upon laws, regulations or those pesky statutes of alleged protective shrouds proudly declared by politicians from both sides “of the aisle”; rather, it is as it always has been — upon the feudal fiefdoms of alliances forged upon meritless applications of weekend romps.

The payment for hard work is the salary one receives; the “extras” depend upon the discount coupons one has discarded over those many years.

For the Federal employee or the U.S. Postal worker, whether under FERS, CSRS or CSRS Offset, the time to consider preparing an effective Federal Disability Retirement application through the U.S. Office of Personnel Management is when the medical condition begins to impact and prevent one’s ability and capacity to perform all of the essential elements of one’s job; and when the afterthought of alliances left unattended results in regrets of unquantified good-will, one should remember that meritocracy is best judged in the faces of a family spent with, and not in the empty beer cans of remorse and despair.

FERS & CSRS Medical Retirement: Meaning, Value and Worth

The last in the tripartite of this conceptual construct possesses a relational significance, where fluctuation of the assigned designation may occur based not upon extrinsic objectivity, but upon a personal sense of attachment, and thus the influence on a spectrum may artificially go up or down depending upon whims of fancy.  The middle term, on the other hand, is often seen to characterize an intrinsic scope, where the assignation of pricing can be determined by market forces, such as the capitalistic paradigm of scarcity of supply and increase in demand coalescing to determine the monetary stability of an essential rating of specified consideration.

The first in the series, then, encompasses both — where derivation attaches to an intrinsic specificity for a given item, but may also alter and amend based upon an intrinsic, personal aura.  It is, in the end, the first for which we strive; for it is meaning that gives fodder to our actions and persistent struggles, while value is that which we attach based upon the objective world around us, and worth can alternate between the historicity surrounding our relationship to the object or the cold detachment we can impart when loss of feeling results in despair.

Of what value does that which we do, have to us, or to the greater society?  That question is often determined by pay, promotions and accolades attributable to accomplishments recognized and applauded.  What is it all worth?  The unstated addendum to such a query, of course, is encapsulated in the following:  “…to you?”  For, worth is often clouded by a sentimental attachment or clouded histories of unknown psychosis; that is why auction houses and bidding wars attempt to portray an impervious face of dispassionate aplomb.

But for meaning, well…  Meaning is what we bring to the fore, embellished by our own sense of bloated narcissism, and derived from childhood dreams and sophomoric pretentiousness.  We attach too little to true value, and too much to sentimental worth.  And when it all comes crashing down because of the fragile house of cards upon which we built our lives, we sit in amazement and wonder, “What did it all mean?”  Such questions will often arise in the midst of a crisis.

For Federal employees and U.S. Postal workers who must contend with a similarly troubling tripartite of parallelism — of meaning (corollary of the medical condition which erupts in questions of why); of value, where the Federal agency or the U.S. Postal Service attaches extrinsic obstacles which signify the course of one’s future within the Agency or the U.S. Postal Service; and worth, which must emanate first from the Federal or Postal worker within the standpoint of whether continuation with the Federal agency or the U.S. Postal Service is even practical, given the loss of meaning and the reduction of value to the Federal agency and the U.S. Postal Service.

In the end, the striving of life is encompassed by the tripartite of human mysteries; we search for meaning in a world devoid of determinable value, and must yet come to terms with the worth of ourselves in relation to the things we do.

That is why, when a medical condition begins to impact one’s ability and capacity to perform one or more of the essential elements of one’s Federal or Postal positional duties, preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is merely an intermediate step towards finding the next phase in the search for meaning in life, the value of the search, and the worth for which we struggle.
