FERS Disability Retirement from OPM: Before and After

Do you remember those old pictures on the advertising pages of various magazines?  Or, perhaps they are still there?

Whether for diets, some “Atlas He-Man” powder to build muscles; where the “before” picture is always grainy and indecipherable; whereas the “after” photograph is of a beaming, smiling, clearly and visibly an ecstatic person, satisfied and happy with the product and the end results.

But the question itself is somewhat irrelevant — for, of course, in one sense, it is not the same person; the person “after” is different because that is the whole purpose of the advertisement, to convey to the reader that the person “after” is a different person from the person “before”, and the photographs are meant to show you the difference.

So, is it false advertising if the person photographed in the “after” picture is not the identical person as the one shown “before”?

In one sense, it obviously is, because the advertisement is trying to persuade you that the product being sold is what caused the change, and surely if you photograph the “before” person as being the same — but now different — as the “after” person, some semblance of subterfuge was engaged in.

On the other hand, if the whole purpose of the advertisement is to convince you that both the “before” person and the “after” person (both of whom presumably used the product being sold) are, in fact, “different” from one another, then how is it that there is any falsity in the advertisement?

For Federal employees and U.S. Postal Service workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, clearly — and without false advertising — there is a difference between the “before” and the “after”.

Before the medical condition, the Federal or Postal employee was a vibrant, productive worker.  After the chronic medical condition — well, the clear necessity to prepare an effective Federal Disability Retirement application under the FERS system tells the whole story.

OPM Disability Retirement under FERS: The Bellwether

It is the leading sheep of the flock, graced with a bell on its neck in order to establish its role for the others; or, in more colloquial parlance, the predictor or indicator of something.

Thus, a red sky may be the bellwether of a coming storm (not being a seaman, one forgets whether it is the night or morning sky which is the predictor).  If one is superstitious, a cracked mirror or the unexpected crossing of a black cat is likely a bellwether of something — although, in modernity, perhaps the anachronisms no longer apply.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition no longer allows the Federal or Postal employee to continue in his or her Federal or Postal job, the question of a bellwether is appropriate.

Under FERS Disability Retirement laws, one must be able to show that a medical condition will last a minimum of 12 months.  One does NOT have to wait the 12 months in order file; merely, that a doctor can, within reasonable medical probability, “predict” or provide a prognosis that a medical condition will last for at least that long.

Most Federal and Postal workers “know” from the start whether or not a medical condition will last a minimum of 12 months; such a bellwether is not rocket science, but more of an intuition established by one’s sense of one’s own health.

Federal Employee Disability Retirement: Reactive Responses

By haste do we regret; by unthinking actions do we abide the fool.  Have you seen the sign often placed at the Clerk’s window at the local courthouse?  It will read something to the effect of: “Your procrastination does not create my emergency”.

Reactive responses, whether based upon a “real” emergency or one which seemingly appears so, are often the basis for later regrets and irreparable damage.  It is like the rule that everyone should follow in sending emails or posting comments on the Internet: Wait a day; sleep on it; set it aside for later consideration.

It is the Roman Stoic, Seneca the Younger, who wrote that, “If a man knows not to which port he sails, no wind is favorable”.  It is, in the end, the essence of Stoicism — of living life without complaint and without being impacted by the hardships of the objective world, all the while clinging to a path of virtue unfettered by worldly concerns.  That is why the quote above — of the internal “self” in contrast to the metaphor of the objective world: the winds which guide the ships — encapsulates the essence of the philosophy of Stoicism.

In modernity, it matters little from whence the winds come, for we engineer our own direction through engines and mechanical devices which propel the marine vessel by the power of our own creation.  But of that time when ships relied exclusively upon the breath of gods that blew the winds which filled the sails — it was a time when we relied heavily upon the favor of fate and nature’s appeasement.  Yet, even today, whether by the propulsion of machines invented or reliance upon prayers of guidance, no wind is favorable until and unless a person knows where he or she wants to go.

Would you hold a dinner party without preparing?  Or attend an important meeting, host a regal gathering of accomplished celebrities or go camping in the wilds of winter’s ferocity — without making adequate preparations?

The elaborate extent of such preparations is often correlated with the importance, significance, relevance and complexity of the issue at hand, the engagement to be embraced or the event to be held.  Preparations are a vital component to the successful engagement of whatever one undertakes, and lack of it often guarantees a result of negative returns.

OPM Disability Retirement Representation: The habit that prevents

Kant was known to have followed a daily habitual routine that was marked with such precision that townspeople would set their watches and clocks by his various points of presence — i.e., if he was by the butcher’s shop, it was 3:15:17; if at the corner of Kroenigsburg Street, 3:16:09; and when he turned the corner of 7th and Main, it was 3:20:12.

One wonders if, had he paused at a random street corner to sneeze, would time have stopped, the universe become paralyzed, and the gods of the underworld been defeated in paroxysms of trembling fright?  Or, had he broken the daily routine of predictable sequences of the uninterrupted sojourn, marked by the two-steps-tap-tap with the cane of his choice, over and over again — step, step, tap, tap; step, step, tap, tap — would anyone have noticed?

Certainly, the townspeople would; and perhaps his rigid philosophical outlook, his moral foundation of principles that forever retained the universality of truth — maybe rigidity may have faltered and we would all be the poorer for it.

Could his mind have expanded into other arenas of philosophical discourse had he traveled beyond and broken the habit that prevents?  Does one’s actions of daily monotony determine the “type” of mind, thoughts, conscious processes, cognitive approaches, etc., such that there are habits that limit, prevent, pause or otherwise freeze?

Habit is a peculiar trait for human beings; it offers both solace and a sense of security in the very regularity of its path, somewhat like the repetition of a musical stanza that is both anticipated and relished despite its very predictability.  It becomes a harmful dependency, however, when the habit that prevents begins to forestall, stunt and actively become an obstacle that restrains necessary growth.

For the Federal employee and U.S. Postal worker who suffers from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, it may well be that the habit that once allowed for success — of being punctual; of overextending one’s capacity in order to accomplish the impossible; of having such a dedication to “the mission” that one’s own health was always secondary — while honorable and laudatory while it lasted, may be the habit that now prevents.

Prevents what?  Of seeking greater health, of changing course in order to set a different goal; of preparing, formulating and filing an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

Attorney Representation Federal Disability Retirement: Life puzzles

Depending upon the accent or inflection, the phrase can take on differing meanings.  If stated in a monosyllabic intonation, it can be a quiet declaration that the entirety of life is comprised of multiple puzzles in an inert, non-participatory manner.  The other way of “saying it”, is to pause between the two words in dramatic form, or even put a question mark at the end of the phrase, making the second word into an active verb and the noun of “Life” into a projectile that deliberately confounds and obfuscates.

In either form, we all recognize the truth underlying the sentiment: from birth to the continuum of living daily the challenges and encounters, it is always a constant struggle to try and maintain a semblance of rationality in a universe that continually creates flux and mayhem.  That was the philosophical strain that was always taught between the contrasting foundations of Parmenides and Heraclitus; of the wholeness and unity of Being as opposed to the constant flux and change that the world imposes.

Life puzzles us in so many ways, and the life puzzles that confront us daily confound and confuse.  See the subtle difference between the two ways of using the phrase?  In the first, it is in an “active” form, invoked as a verb (transitive or intransitive), whereas in the second, it is used as a noun.  We can get caught up in the grammatical form and usage of words, and in the process, get lost in the theoretical issues surrounding words, concepts and thought-constructs surrounding so many endless and peripheral issues; but the point of recognizing such subtle differences in the language we use is precisely to avoid and deconstruct the confusions we create within the language we use and misuse.

In either form of usage, it is important to state clearly how and for what purpose we are engaging in a formulation of words, thoughts, concepts and narrations.  We all carry narratives within ourselves that we must be ready, willing and able to use in order to describe, explain and delineate.  Those subtle differences that words create must always be untangled.

For Federal employees and U.S. Postal workers who are considering filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the importance of being able to distinguish between subtle forms of language usage cannot be over-emphasized.  For, Standard Form 3112A, Applicant’s Statement of Disability, is in and of itself a life puzzle that puzzles even the clearest of puzzling lifetimes; it is, moreover, a legal conundrum and a language puzzle that must be carefully reviewed, discerned, untangled and responded to by first recognizing that life does indeed involve puzzles, and such life puzzles must be approached in a non-puzzling way.

Early Medical Retirement from Federal Government: Berkeley’s House

He was an Irishman, and if one were to “rank” philosophers, he would likely be considered a “second tier” thinker — not quite at the level of Plato, Aristotle, Descartes or Heidegger — but certainly contributed to the Western Philosophical tradition of engendering even greater questions than solving any problems or settling any queries.

A little tidbit which is not commonly known: Bishop Berkeley came to the United States and purchased a plantation at Middletown, intending upon living there, until his expectation of funding failed to be forthcoming.  That is probably what he is least known for; the Latin phrase for which he gains the greatest notoriety, is esse est percipi — to be, is to be perceived.

An absurd and uncharitable interpretation of this foundational phrase, would be to attribute to Berkeley the idea that things in the objective world exist only to the extent that we perceive them; the moment such perceptual pervasiveness disappears, then, existence becomes extinguished.

A more rational view of his postulate, however, is to attribute Berkeley to the tradition of British linguistic philosophers, and to consider the following “implied” but silent intentions:  “The definition of what it means to exist, can only have meaning if, and only if, there is a perceiver for which the object is there to be perceived, and as such, existence as a concept of any meaningful import must by necessity have a perceiver”.

Without this kinder, gentler version of interpretive connotations, all manner of ridicule and scoffing have been thrown at the good Bishop — in the form of:  “So, when I leave a room, does it vanish?  And when I return, does it suddenly reappear?”  And in the days of Star Trek:  “Beam me up, Scottie, or in philosophical circles, Bishop Berkeley”.

It is, in the end, the absurdity of linguistic interpretation which ultimately relegated Berkeley to the “second tier” of philosophical thought; and from that unintended consequences resulting from an attempt to resolve a complex issue of metaphysical discourse, we can learn and discern much:  complexity sometimes cannot be circumvented with simplicity of declarative assertion; often, there is a reason why such a conundrum of linguistic inelasticity exists.

Thus, for the Federal employee or U.S. Postal Service worker who is intending upon preparing a Federal Disability Retirement application to be submitted to the U.S. Office of Personnel Management, whether the Federal or Postal worker is under FERS, CSRS or CSRS Offset, the key point here is that, yes, your case may be quite complex, but the route to making it comprehensible to the administrative specialist at OPM, is not to try and simplify the core essence of the case, but to state the complex in simple language.

That is often the greatest difficulty with a Federal or Postal applicant in preparing one’s Statement of Disability on Standard Form 3112A — the narrative in response to the various questions will often meander and fail to achieve a coherency because everything from Dickens’ childhood details (which, as you may recall, Salinger scoffed at in his famous work, The Catcher in the Rye) to peripheral issues involved EEO complaints and workplace harassment concerns are thrown in for good or seemingly better measure, when in fact a simplified version based upon good habits of editing would produce a more effective statement of compelling narration.

For, in the end, postulating a Federal Disability Retirement application is not a matter of compiling a voluminous or complex treatise for persuasive discourse; it is to tell a coherent story of one’s inability to perform one or more of the essential elements of one’s positional duties with the Federal job or Postal position, and we need not defer to Berkeley’s House — whether as a historical tidbit or as the confounded thought processes extracted from his complex works — in order to prepare, formulate and file an effective Federal OPM Disability Retirement application.

Federal Disability Retirement Benefits: The Soliloquy

For the stage actor, it is the consummate moment of the trade — the opportunity to reveal the depth of character before an audience whose attention is monolithically focused upon the singular pinnacle of highlighted speech.

Shakespeare’s monologues of anguish and despair, of the most private of thoughts spoken through an accepted device of artistic asides which allows for the viewing public to listen in on reasonings otherwise hidden but for conversations with others or the ravings and rantings of the fool who sputters.  Yet, how reflective of true life such moments are, of the soliloquy which we engage but in the quietude of unspoken words.

For Federal employees and U.S. Postal workers who suffer in silence because of the medical condition which is revealed, or hidden but painfully debilitating for fear of supervisors, managers or coworkers suspected of unwarranted viciousness of behavior, the unspoken thoughts and processes of rational discourse within should ultimately be bounced as against expertise and guidance for one’s future.
